I, the undersigned, understand and acknowledge that the use of the indoor baseball facility. The Battery, involves inherent risks, including but not limited to batted balls, thrown balls, swinging bats, and other related activities. I voluntarily assume all risks and responsibilities associated with my participation in activities within the facility.

In consideration of being permitted to use the indoor baseball facility, I hereby release, waive, discharge, and covenant not to sue The Battery, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or rights of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while using the facility. The owners of the facility will be held harmless for any accidents or injuries resulting from activities inside the facility.

I understand and agree that this release includes any claims based on the negligence, action, or inaction of The Battery, its owners, employees, agents, or representatives, whether a COVID-19-related incident or any other injury or harm.

If the participant is under the age of 18, I, as the parent or legal guardian, understand and acknowledge the risks associated with the use of the indoor baseball facility on behalf of my child. I consent to my child’s participation and agree to all the terms and conditions outlined in this waiver on their behalf.

I understand the rules and regulations of The Battery and agree to comply with them for the safety of myself or my child.

I have read this waiver thoroughly, understand its terms, and voluntarily sign it as my own free act and deed.
